PLEASE READ THIS NOTICE AS IT CONSTITUTES PART OF
YOUR CONTRACT FOR
TRAVEL RELATED SERVICES WITH AWESOME ADVENTURES TRAVEL & TOURS.
TERMS & CONDITIONS:
You acknowledge
and understand that Awesome Adventures Travel/AATTA.com is acting as an
agent for suppliers in selling travel services and products which are
not directly supplied by Awesome Adventures Travel/AATTA.com, including,
but not limited to air transportation, hotel accommodations, ground
transportation, meals, tours, cruises. Awesome Adventures Travel/AATTA.com
shall not be responsible for any acts or omissions on the part of such
suppliers (including but not limited to breach of contract, negligence,
conversion, fraud or other civil wrong doing), which may result in any
loss, damage, delay, cost, inconvenience, or injury to you or your
travel companions or group members.
In addition Awesome Adventures Travel/AATTA.com shall not be
responsible for any injuries, costs, damages, or losses caused to any
traveler in connection with terrorist activities, social or labor
unrest, acts of war, acts of God, mechanical or construction
difficulties, diseases, local ordinances, regulations, statutes or laws,
climatic conditions, abnormal conditions or developments, or any other
actions, omissions, or conditions not subject to the control of Awesome
Adventures Travel/AATTA.com. By
embarking upon your travel, you voluntarily, knowingly and intelligently
assumes all risks involved with such travel for you and all members of
your travel party.
We make no guarantees regarding any aspect of your confirmed
reservation, including special request, as elements beyond our control
may change components as deemed necessary by supplier, airline or tour
operator. It is understood that you are acting on behalf of all members
of your travel party when confirming your reservation and will hold
Awesome Adventures Travel harmless in any matter that may or may not be
covered by the Optional Travel Protection plans available to you, or
that is out of the agency’s control.
If your package
includes hotel, you may be required to provide a valid credit card or
cash deposit at check-in to cover in incidentals (i.e. long distance
telephone calls, room service, etc.) which is not covered in your
package price. If your package includes a car-rental, you must be at
least 25 years of age, have a valid driver’s license, and you must
provide a valid credit card upon check-in. Additional fees by hotel and
auto rental agencies may be required for travelers 21 - 25 years
of age. During selected holiday and peak
travel periods, such as Christmas/New Year's, winter school break and
Easter, your penalties may be higher and still subject to the supplier
fees.
Cancellations and Changes
All cancellation or change requests must be confirmed using our
Cancellation/Change Request Form.
The right to a refund if you change your travel plans is limited.
It is strongly recommend that the Optional Trip Protection be purchased
to help cover supplier cancellation penalties or change fees.
All requests for refunds after a trip must be made no later than 3
business days after completion travel. No refund will be made for
features the Participant opts not to use or if boarding is denied
to passengers who do not have acceptable identification (i.e. Drivers
License, or other acceptable form of government issued photo ID) AND
proper proof of citizenship for international travel.
A valid Passport is highly
recommended. If applicable, a portion of or the total amount of
any credit due may be issued in the form of vacation vouchers as per
individual supplier/tour operator policy. It is understood that if you
decided to modify or cancel your booking once confirmed with a deposit
the following Agency fees will apply to cover administrative cost and
services rendered in producing this booking: Changes: $50.00 per modification, Full Cancellation $150.00. Agency fee(s)
are in addition to any supplier/airlines fees. Published Airfares are
100% Non-refundable. In the event of a change or cancellation the total
cost of the Optional Travel Protection Plan is non-refundable and may
only be used once for either occurrence. If you have purchased trip
protection/penalty waiver, you may file a claim for reimbursement of
covered losses, penalty or cancellation fees with the insurance
provider. All vacation/cruise packages are listed in
US
currency unless otherwise noted. You
agree to pay for the vacation or cruise package in US funds.

Warranties and
Exclusion of Warranties
Awesome Adventures Travel/AATTA.com makes no warranties whatsoever,
express or implied, to you, or other members traveling with you and
EXPRESSLY DISCLAIMS AND EXCLUDES THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY LIABILITY
FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE
DAMAGES, INCLUDING LOST PROFITS OR LOST REVENUE. You further acknowledge
that no other representations were made to you or relied upon by you.
Any unresolved legal
issues must be presented in NY state, Queens County.
The law of the state of
New York
and the rules of the American Arbitration Association shall govern any
dispute or claim made under this agreement or between the parties. The
forum for any such dispute or claim shall be the American Arbitration
Association and venue shall be
Queens County,
New York.
